We have seen a number of real estate "gurus" who want to teach you about the so-called "Subject To (Subject 2, Sub2)" method of investing. Our program does not include the Sub2 simply because it is unethical and immoral. In some instances, it even constitutes fraud, and only in two states can it be used without triggering a "due on sale" clause in the seller's mortgage.

And those are the same reasons we will not go into detail here. The "short take" is this: the seller is required to sign over all rights in the property without giving up any of the responsibilities. If the deal goes sour, or if the "investor" cannot complete the deal, he can simply walk away and the seller is stuck. And, if the seller's bank gets wind of a Sub2, the lender can call the seller's entire mortgage due immediately (in all but two states). For these reasons, we consider the "Subject 2" method unethical and immoral.
